Terms & Conditions of GoGo

Terms & Conditions document is an arbitration agreement and class action waiver that apply to all claims brought against GoGo in the United States. Please read them carefully.

Words and definitions used in this document

” Terms” or” Terms & Conditions of Service” are a binding legal agreement between you and GoGo.

” GoGo Platform” – Terms & Conditions govern your use of the websites, applications, and other offerings from GoGo.

” GoGo”, ” we ,” ” us ,” or ” our” refers to the GoGo entity. Below shows you with whom you are contracting.

” GoGo” is the provider of the Platform

” GoGo” does not own, control, offer or manage any Listings

” GoGo” is not a party to the contracts concluded directly between Hosts and Guests

” GoGo” is not a real estate broker or insurer

” GoGo” is not acting as an agent in any capacity for any Member.

” GoGo” has more Terms, like the

Privacy Policy, describing our collection and use of personal data

Payment Terms, describing the payment services provided to Users by the GoGo.

” Users” – You when using the GoGo Platform. Users can publish, offer, search for, and book services.

” Hosts” - Users who publish and offer services. Hosts offer accommodations. They can also offer activities, excursions, and events,

” Accommodations” or ” Listing” - A place to stay as listed on the GoGo Platform.

” Guests.” - Users who search for, book, or use services.

” Profile” – Your information registered as an account to access and use the many features of the GoGo Platform. The Profile must be kept accurate and current.

If you Host, you are responsible for understanding and complying with all laws, rules, regulations and contracts with third parties that apply to your Host Services.

Guest Terms

1. Our Mission.

Our mission is to provide the best quality service for our users.

2. Booking on GoGo.

2.1 Accommodations. On GoGo you can find Accommodation Listings by typing travel destination, travel dates, and number of guests. Filters can also be used to refine your search results. Results are based on the relevance to your search, and other criteria. Relevance considers factors like price, availability, Reviews, customer service and cancellation history, popularity, previous trips and saved Listings, Host requirements (e.g., minimum, or maximum nights), and more. There is more information about search results in our Help Center.

2.2 Booking. When you book a Listing, you agree to pay all charges. Charges include the Listing price, applicable fees like Gogo Service Fees, offline fees, taxes, and any other items identified during checkout (collectively, Total Price). You also agree that GoGo Payments may charge and collect any security deposit identified during checkout. When booking is confirmed, a contract for Host Services is formed between you and the Host. Cancellation policies and any other rules, standards, policies, or requirements identified in the Listing or during checkout form part of your contract with the Host.

2.3 Destination Reservations. Your location reservation is a limited license to enter, occupy, and use as listed. Your Host retains the right to re-enter the location during your stay, to the extent: (a) it is reasonably necessary, (b) permitted by your contract with the Host, and (c) consistent with local applicable law. Staying past checkout could have the Host make you leave in a manner consistent with local applicable law. This may include imposing reasonable overstay penalties. Each location has a maximum number of allowed Guests.

2.4 Services by Host. Some locations may offer an event along with your stay. In confirming your participation and that of your guest(s), you are responsible for confirming that you and your guest meet minimum age, or other requirements. Your responsibility is to inform the Host of any medical or physical conditions, or other circumstances that may impact your ability to participate, attend, or use this Service. You may not allow any other person to join this event offered by the Host unless they are included as an additional guest during the booking process or otherwise expressly authorized

3. Booking Modifications include Cancellations, Travel Issues, Refunds.

GoGo offers the Platform and the Customer Service Department to make any Booking Modifications that may be agreed upon by the Guest and Host. Any additional amounts, fees, or taxes associated with the Booking Modifications are the sole responsibility between the Guest and the Host.

3.1 Cancellations, Travel Issues, and Refunds. If as a guest, you cancel a reservation, the cancellation policy determines the amount of the refund. However, there are circumstances when other policies take precedence and will determine the amount of refund awarded you. The Extenuating Circumstance Policy may award you a partial or full refund when circumstances manifest that are beyond your control. Host cancellation, or Travel Issues (as defined in the Guest Refund Policy), may award you a rebooking assistance or a partial or full refund. Refunds and the situation to which they apply, and how they apply, are detailed in each Policy.

4. Your Assumption of Risk and Responsibilities.

4.1 Your Assumption of Risk. You acknowledge that many activities carry inherent risks and agree that, to the maximum extent permitted by applicable law, you assume the entire risk arising out of your access to and use of the GoGo Platform and any Content (as defined in Section 10), including your stay at any Accommodation, use of any other Host Service, or any other interaction you have with other Members whether in person or online. This means it is your responsibility to investigate a Host Service to determine whether it is suitable for you. For example, Host Services may carry risk of illness, bodily injury, disability, or death, and you freely and willfully assume those risks by choosing to participate in those Host Services.

4.2 Your Responsibilities. The responsibility and liability of your own acts and omissions and the acts and omissions of anyone accompanying you to the Accommodation, or Host Service falls squarely upon you. This includes the following:

(a) The Accommodation (and related personal property) are to be left in the

condition it was in when you arrived.

(b) Act with integrity, treat others with respect, and always comply with applicable

laws.

(c) Additional guest(s) who are minor or if you bring a minor to the Accommodation, you must be legally authorized to act on behalf of the minor(s) and you are solely responsible for the supervision.

Host Terms

5.1 Hosting on GoGo. As a GoGo Host, we offer you the opportunity to have others enjoy your Accommodation, or other Host Service. You can earn money doing so. Just list your property and you are in control of how you host - set your price, availability, and host rules for each Listing.

5.2 Contracts with Guests. A Contract begins when you receive a booking confirmation through the GoGo Platform. You are enrolling into a contract with the Guest and therefore are responsible for delivering your listing terms and conditions and other Host Services. For each booking, you are agreeing to pay GoGos service fee (and applicable VAT and taxes). Fees you owe GoGo will be deducted from your payout unless there is a confirmed agreement stating otherwise. All terms, policies, or conditions included in any secondary contract with Guests must: (a) be in accordance with these Terms, our Policies, and the information provided in your Listing, and (b) be prominently disclosed in your Listing description.

5.3 Working Relationship.

  1. Hosts are independent and are not directed by GoGo.
  2. Hosts are an individual, an entity, or an agent of GoGo.
  3. Hosts have complete discretion as to the time, terms, and price, they provide Host Services.
  4. Hosts are not GoGo employees.
  5. GoGo acts as a payment collection agency as described in the Payments Terms.

6. Managing Listing

6.1 Create Listing.

The GoGo Platform has built in services that enable easy listing. Your listing must include all accurate information pertaining to hosting services like cleaning charges, Host Service, your price, resort fees, security deposits, property fees, taxes and all rules and/or requirements that apply to your Guests or Listing.

Your Listing should include:

  1. Calendar availability.
  2. Property contents as displayed on the website (should be up to date).
  3. Accurate insurance for all the accommodation and service provided. The host must ensure the policies are in place and periodically reviewed.
  4. The one listing for your accommodation.
  5. Additional places to stay if you have them available on your property.

6.2 Legal Obligations.

It is the hosts responsibility to comply with the following:

  1. Legal regulations, bylaws, and contracts with third parties that apply to your Listing.
  2. Be-aware of restrictions prescribed by landlords, leaseholders, homeowners, and/or condominium association. Subletting, short-term rentals and/or longer-term stays are often prohibited by these entities.
  3. Be-aware of zoning laws enforced at certain locations and residential properties.
  4. Be-aware of jurisdiction laws on the various host services permitted for obtaining license for example:
  5. Preparing food, serving alcohol for sale, guiding tours, or operating a vehicle). In some places, the Host Services you want to offer may be prohibited altogether.
  6. Be-aware of jurisdiction requirements for guests visiting your property.
  7. Be-aware of tenancy rights for Guests and additional obligations for Hosts, such as:
  8. Eviction laws that may apply for longer stays.
  9. Local rules that apply to the Host Services you plan to offer.
  10. Legal requirements, lawful information as provided to satisfy your independent obligations.
  11. Usage of the personal data of Guests and others in compliance with applicable laws, privacy laws and Terms, including our  Host Privacy Standards.
  12. Legal advice for local laws and your legal rights.

6.3 Recommendations. Recommendations of the Listing order depends on a variety of factors, including:

  • Frequency of search (e.g., number of travelers, duration of stay, pricing),
  • Listing characteristics (e.g., price, availability, image presented on the website, Host reviews, popularity),
  • User friendly booking site experience (e.g., travel support and history of the Host),
  • Host needs (e.g., duration of stay, booking hours), and
  • Pre-Condition of Guest (e.g., previous trips, saved Listings, Location from where the Guest is searching).

For your convenience, GoGo keeps search results the same on the website as well as the mobile application user friendly. Hosts may promote their listing using GoGos Community Platform and by paying an additional fee.   1. Responsibilities:
  2. You are liable for your own acts, neglections, and those of anyone you allow to act on behalf of your Host Services.
  3. Pricing
  4. Rules and requirements for the Listing.
  5. Describing all fees and charges in your Listing
  6. No additional or other fees are to be collected outside the GoGo Platform. (Special agreements can be found Offline Fee Policy.)
  7. Not to encourage the signing of:
  8. Contracts with Guests
  9. Third-party accounts
  10. Submission of reviews
  11. Sharing of contact information
  12. Taking actions outside the GoGo Platform
  13. Commercial Hosting. Co-hosting or Team hosting, as part of a business, or organization must abide to the following:
  14. Individuals and entities are bond to the contract in the same approach.
  15. If you have accepted the terms of the contract the same applies to the entire Host team.
  16. GoGo Payouts to members of the entity can only be designated by an authorized individual of the Host and is responsible for payout information.

6.6 Assumptions of Risk.  You accept that hosting carries inherent risks, and you agree to the assumption of the entire challenges involved while offering Host Services, and/or, all interaction while accessing the GoGo Platform. The risk, laws, rules, and regulations or any obligations are assumed and evaluated by you at the time of listing as the Host Service with GoGo.

7. Booking Issues.

Hosts and Guests are responsible for Booking Modifications, via the GoGo Platform or direct GoGo customer service on their behalf, and they agree to pay any additional amounts, fees or taxes associated.

7.1 Cancellations.

  • Once the reservation is cancelled, the Host payment is determined by the cancellation policy.
  • Valid reasons supported by the GoGo Extenuating Circumstances Policy or applicable law are the only times Hosts should cancel a Guest reservation.
  • If a Host cancels on a Guest without a valid reason, GoGo may impose a cancellation fee and other consequences. If:
  • Guest experiences a Travel Issue (as defined by the Guest Refund Policy),
  • Extenuating Circumstance arises
  • If a reservation is cancelled under Section 13 of these Terms, the Host payout amount is reduced by the amount refunded or otherwise provided to the Guest, and by any other reasonable costs GoGo incurs as a result of the cancellation.
  • If a Guest receives a refund after you have already been paid, or the amount of the refund and other costs incurred by GoGo exceeds your payout, GoGo (via GoGo Payments) may recover that amount from you, including by offsetting the refund against your future payouts.
  • Host Payouts may be delayed until a settlement has been determined for the Guest refund, if the refund needs to be issued because of the following:
  • Guest Refund Policy
  • Extenuating Circumstances Policy,
  • These Terms preempt the cancellation policy

8. Taxes.

8.1 For Host. As a Host, you are liable for calculating and estimating the applicable taxes, VAT, GST, and any direct or indirect taxes. You are under law required to report, collect, remit any or all the necessary taxes imposed by the local, state, city, county, and federal agencies in the location, you have published your listing or in the place of operation. Using any of the GoGo platforms, you confirm that you have taken responsibility for applying and including all the above-mentioned taxes while listing or hosting your property.

8.2 For Guest. We will collect all applicable taxes in the jurisdictions of your booking or stay.

You recognize and agree that tax calculations will vary between properties in the same location or jurisdiction. It is therefore prudent to confirm any taxes applied to the daily booking price with your Host.

In jurisdictions where GoGo facilitates the collection and/or remittance of Taxes on behalf of Hosts, you instruct and authorize GoGo to collect Taxes on your behalf, and/or to remit such Taxes to the relevant Tax authority. Any Taxes that are collected and/or remitted by GoGo are identified to Members on their transaction records, as applicable. GoGo may seek additional amounts from Members (including by deducting such amounts from future payouts) if the Taxes collected and/or remitted are insufficient to fully discharge that Members tax obligations, and you agree that your sole remedy for Taxes collected by GoGo is a refund from the applicable Tax authority. You acknowledge and agree that we retain the right, with prior notice to affected Members, to cease the collection and remittance of Taxes in any jurisdiction for any reason.

8.3 Tax regulations. Tax regulations may require that GoGo collect and/or report taxes and information about you and your earnings to the local, state, county, region, and federal governments. You agree and authorize GoGo to withhold applicable taxes or charges in your payouts.

9. Review Guidelines

The GoGo platform provides and administers an opportunity for the Host and Guests to write reviews about each other. Using the platform, you agree that you will take responsibility for providing the reviews with honesty and integrity. You also confirm that your review will not contain any illegal, discriminatory, false, annoying, offensive, or derogatory words that will harm, hurt, or mislead. You also authorize that the GoGo platform has exclusive rights to delete or remove any reviews.

10. Content Guidelines

To properly communicate various aspects of your listing and stay, the GoGo Platform enables you to provide: media files, audio files, reviews, and additional information. These are termed Content

The attitude of the Contents should follow the guidelines issued by GoGo:

  1. No matter how the content is submitted, posted, or published they are royalty-free, irrevocable, perpetual, sub-licensable and transferable license to copy, modify, prepare derivative works of, distribute, publish and otherwise exploit, that Content, without limitation.
  2. The Privacy Policy is precise and describes the usage of any personal information disclosed across the platform. If GoGo purchases or invests in facilitating the Content creation, it is owned by GoGo and termed Content.
  3. You are the authorized proprietor for your owned Content and abode by these Terms issued by GoGo.
  4. The Content submitted by you must not violate or infringe upon any intellectual property or privacy rights of any third party.
  5. The Content submitted must not discriminate, be obscene, harassing, deceptive, violent, or illegal as covered by our Content Policy and Nondiscrimination Policy.
  6. You agree to the automated tools or translators inbuilt across the GoGo Platform for translation and accuracy of contents submitted.
  7. We do not promise that the translation will be accurate.

11. Fees Guidelines

A certain fee amount is charged to the Host and Guest for usage of services and other information at GoGo. To know about the calculation of the fee amount feel free to visit our Service Fees page. GoGo reserves the right to change the fee amount charged for services at any time. Members will be notified about this fee change, if any, prior to booking. GoGo service fees are non-refundable. You may terminate this agreement as per Section 13.2 if you disagree with any fee change.

12. GoGo Platform Rules.

  • 12.1 Rules. For the GoGo platform to be secure and safe, the following rules are to be followed by all users.
  • We believe in mutual respect and integrity and we ask that all users follow suit.
  • Lying, misrepresentation, not being authentic, polite or respectful are not the manner of the GoGo Platform.
  • We do not tolerate any discrimination on the GoGo platform. Please refer to our Nondiscrimination Policy regarding any questions or concerns.
  • Proprietary Rights and Unauthorized access and usage of Information from the Site are strictly prohibited.
  • You are not allowed to use or copy any Data from our website through manual or automated means since they are copyright protected and therefore consequences will be enforced if you are found in violation of this agreement.
  • You are not allowed to perform any actions which may alter the functionality or affect the performance of the GoGo website in any manner.
  • You are not allowed to reverse engineer any part of the GoGo website.
  • You are not allowed to perform any kind of hacking activities without GoGo consent and written permission.

Only use the GoGo Platform as authorized by these Terms or another agreement with us

  • You wont misuse any of the contact/personal information that you get through GoGo other than for transactional purposes in Gogo.
  • You are not allowed to use the Gogo tools like chat, messenger etc. for sending any messages other than related to your booking through GoGo.
  • GoGo will not recommend accepting any kind of payment
  • Do not request, make, or accept a booking or any payment outside of the GoGo Platform to avoid paying fees, taxes or for any other reason. See our Offline Fee Policy for exceptions.
  • Do not require or encourage Guests to open an account, leave a review, complete a survey, or otherwise interact, with a third-party website, application or service before, during or after a reservation, unless authorized by GoGo.
  • Do not engage in any practices that are intended to manipulate our search algorithm.
  • Do not book Host Services unless you are actually using the Host Services.
  • Do not use, copy, display, mirror or frame the GoGo Platform, any Content, any GoGo branding, or any page layout or design without our consent.
  • Honor your legal obligations
  • Understand and follow the laws that apply to you, including privacy, data protection, and export laws.
  • If you provide us with someone elses personal information, you: (i) must do so in compliance with applicable law, (ii) must be authorized to do so, and (iii) authorize us to process that information under our Privacy Policy.
  • Read and follow our Terms, Policies and Standards.
  • Do not organize or facilitate unauthorized parties or events. You are responsible and liable for any party or event during your reservation that violates our rules for parties and events, as incorporated by reference herein.
  • Do not use the name, logo, branding, or trademarks of GoGo or others without permission.
  • Do not use or register any domain name, social media handle, trade name, trademark, branding, logo, or other source identifier that may be confused with GoGo branding.
  • Do not offer Host Services that violate the laws or agreements that apply to you.
  • Do not offer or solicit prostitution or participate in or facilitate human trafficking.

12.2 Reporting Violations. If you believe that a Member, Listing or Content poses an imminent risk of harm to a person or property, you should immediately contact local authorities before contacting GoGo. In addition, if you believe that a Member, Listing or Content has violated our Standards, you should report your concerns to GoGo. If you reported an issue to local authorities, GoGo may request a copy of that report. Except as required by law, you agree that we are not obligated to act in response to any report.

12.3 Copyright Notifications. If you believe that Content on the GoGo Platform infringes copyrights, please notify us in accordance with our Copyright Policy.

13. Violation Consequences:

13.1 Term. You agree to the Terms and Guidelines mentioned below. Every individual user when entering any GoGo Platform, automatically complies and acts in accordance the terms effective immediately. The agreement remains intact until terminated in accordance with these Terms

13.2 Termination.

  1. If your account is dormant for one year, it will be deactivated without any prior notice.
  2. Your email to GoGo about cancellation can be sent any time.
  3. You might receive a written communication from GoGo 30 days prior to terminating your account.
  4. Any breach of agreement or violations of the policies will also be taken into consideration of termination of the account.

13.3 Member Violations.

  • We believe in earning trust and maintaining rapport built with our users, Hosts, team members, partners and all third parties associated with us. Therefore, if we notice any kind of regulation or policy violations GoGo reserves the right to suspend, cancel, limit, or remove the following without notice:
  • Access to the GoGo Platform
  • Listings, Reviews or other Content
  • Pending or Confirmed Bookings

13.4 Minor Violations.

All users hold the right to appeal and resolve any actions taken by GoGo for minor violations of any Policies or Regulations.

For any reservation cancelled by Guests or by Host, payment to Host will be reduced by the amount refunded to the Guest or any other costs incurred by GoGo for the Guest because of the cancellation. For more information, please refer to the Cancellation and Refund Policy.

13.5 Legal Mandates. GoGo appreciates the laws enforced by Governmental bodies, Law enforcement, Administrative agencies, Local legislatures for any action determined to be necessary. Including the measures taken in Section 13.3 & 13.4.

13.6 Effect of Termination.

A User should not sign in with a different name or use another members ID to sign into the platform for booking or cancellations as it results in termination.

Once your account is deactivated, due to any violation, your account will be terminated, user can no longer complete or cancel reservations.

If the member terminates or deactivates the account during booking the transaction remains invalid.

If you are Host and your GoGo account is terminated, any booking will be automatically cancelled and a full refund will be awarded to the guest account.

If the GoGo agreement is terminated all your transactions are Suspended and you are not entitled to restore your account.

13.6 Survival. Parts of these Terms that by their nature survive termination, will survive termination of this agreement, including Sections 2 through 26.

14. Modification.

Terms of this Agreement may be modified by GoGo at any time. Any material changes made during its tenure will be informed via email 30 days prior to the implementation of changes. If you disagree to any modified terms mentioned, you may terminate immediately. If you do not terminate the agreement before the revised dates, you automatically continue to agree with the agreement and its modifications.

15. Resolving Complaints and Damage Claims

15 Casuality and Hardship Resolution.

If a Causality or Hardship has occurred, the following steps can be considered for resolution.

  1. The affected member can seek assistance from the Help Center
  2. If the affected member heightens the claim to GoGo, the member causing the casualty or hardship may be given an opportunity to respond.
  3. If the member having caused the casualty, agrees to pay, or if GoGo intervenes by having the member causing the hardship to pay in full, can collect the required sum to be paid directly from the member or be recovered from their security deposit.
  4. GoGo reserves the right to approach any insurance policies maintained by you or obtain direction from applicable laws.
  5. The affected member agrees to cooperate and accept the reasonable actions furnished by GoGo to fulfill their damage claims.

16. GoGos Role.

We exist purely for the benefit of our Users to publish, offer, search for, and book accommodations and any services offered by Hosts across the globe.

The conduct of individual Guests and Hosts is not part of our obligations, but we do everything within our power for all members to have a great experience while using GoGo. For Example:

  1. Risk involved while accessing Host or third party Wi-Fi is not under our control.
  2. The removal of Host properties from the Platform.

It is agreed that GoGo has the right, but not the obligation to monitor and verify all content and information provided by Members while using the Platform. For Example:

  1. Inaccuracies and discrepancies in documents submitted
  2. Location access to the property
  3. License approval for Guest admittance and events
  4. Eligibility of User Experience (??)
  5. Credential Disclosure (Single user profile not accessible by other users)

Members agree and accept the terms and GoGos interpretation of policies and conditions administered. Members agree to cooperate in good will and with full disclosure when providing information required for any reasonable action or claim.

Furthermore, you agree that interpretation is not taken by GoGo as an agent with respect to the payment Terms

Members acknowledge and agree that GoGo administers its Policies (such as our Extenuating Circumstances Policy) and Standards (such as basic requirements for hosts), including decisions about whether and how to apply them to a particular situation, at its sole discretion. Members agree to cooperate with and assist GoGo in good faith, and to provide GoGo with such information and take such actions as may be reasonably requested by GoGo with respect to any investigation undertaken by GoGo regarding the use or abuse of the GoGo Platform. GoGo is not acting as an agent for any Member except for where GoGo Payments acts as a collection agent as provided in the Payments Terms.

17. Member Accounts.

To access the GoGo Platform you should fulfill the following criteria:

  1. Member should be of the age of 18 and above
  2. You are not previously barred from using the GoGo Platform by law or any legal authorities.
  3. Proof of legal citizenship status.
  4. Keeping your Personal Profile up to date.
  5. Single user keeps a single profile. Do not share or register more than one account.
  6. You should not Disclose any Confidential Information or OTP (One Time Password) sent to your communication support.
  7. Notify any discrepancy or stolen identity or otherwise compromised information of your account.

GoGo reserves the right to, when permitted by local law to ask for additional background information including the following:

  1. Screen your activities against third-party databases
  2. Sex offender registration disclosure
  3. Public Records of Criminal convictions
  4. Undertaking of any checks in regard to your profile

You must register an account to access and use many features of the GoGo Platform. Registration is only permitted for legal entities, partnerships and natural persons who are 18 years or older. You represent and warrant that you are not a person or entity barred from using the GoGo Platform under the laws of the United States, your place of residence, or any other applicable jurisdiction. You must provide accurate, current, and complete information during registration and keep your account information up to date. You may not register more than one account or transfer your account to someone else. You are responsible for maintaining the confidentiality and security of your account credentials and may not disclose your credentials to any third party. You are responsible and liable for activities conducted through your account and must immediately notify GoGo if you suspect that your credentials have been lost, stolen, or your account is otherwise compromised. If and as permitted by applicable law, we may, but have no obligation to (i) ask you to provide identification or other information, (ii) undertake checks designed to help verify your identity or background, (iii) screen you against third-party databases or other sources and request reports from service providers, and (iv) obtain reports from public records of criminal convictions or sex offender registrations or their local equivalents.
